1. THE SERVICE MANDATE
FindAgentsNow (“The Service”) acts as a specialized market intelligence and referral consultancy. Our function is to analyze production data and provide a vetted recommendation for a real estate professional (“The Agent”). By using this site and our services, you acknowledge that FindAgentsNow is not the Broker of Record for your property transaction. We provide the intelligence; we do not sell the house.
2. INDEPENDENT DUE DILIGENCE (The “Verify” Clause)
While we employ a rigorous, data-driven audit to identify top-tier talent, you (The User) are the final decision-maker.
- No Control Over Operations: The Agents we recommend are independent contractors or third-party business entities. We do not control their daily operations, schedules, or specific marketing tactics.
- Your Duty to Vet: Our recommendation serves as a high-level introduction to a verified producer. It is your responsibility to interview the Agent, review their specific contract terms, and determine if they are the correct cultural fit for your objectives before signing any listing or representation agreement.
- The Final Decision: The decision to hire the Agent is yours alone.
3. NO WARRANTY OF PERFORMANCE
Real estate markets are volatile and subject to macroeconomic forces beyond the control of any single agent or consultant.
- No Guarantees: We do not guarantee specific outcomes, including but not limited to: final sale price, time on market, or the successful closing of any transaction.
- Past Performance: Historical data (Closing Ratios, Sales Volume) is used for vetting purposes only. Past performance is not a guarantee of future results.
- Educational Content & Articles: All guides, blog posts, and articles provided on FindAgentsNow are for informational and educational purposes only. We make no warranties or representations regarding the accuracy, completeness, or timeliness of this published content. Our articles do not constitute formal legal, financial, or binding real estate advice, and you apply these strategies entirely at your own risk.
4. LIMITATION OF LIABILITY
To the fullest extent permitted by law, FindAgentsNow and its officers, directors, and consultants shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:
- The acts, errors, omissions, or negligence of the recommended Agent.
- Any disputes arising between you and the Agent regarding commissions, marketing strategy, or contract performance.
- Financial losses associated with the sale or purchase of your asset.
By accepting our recommendation, you agree to hold FindAgentsNow harmless from any liability regarding the Agent’s conduct.
5. FINANCIAL TRANSPARENCY
We operate on a performance basis. In many cases, FindAgentsNow receives a referral fee from the successful closing of a transaction facilitated by our introduction. This fee is paid by the Agent/Brokerage and does not increase your cost of service. We are compensated only when you successfully close.
6. INTELLECTUAL PROPERTY
The “Strategic Market Audit,” “The 24-Hour Verdict,” and our proprietary vetting methodologies are the intellectual property of FindAgentsNow. Unauthorized reproduction of our intake forms or analysis logic is prohibited.
7. GOVERNING LAW
These terms shall be governed by the laws of the State of [Your State]. Any disputes arising from this agreement shall be resolved through binding arbitration in [Your City], rather than court.
